21 Nov. 05: High Court rules use of "neighbor procedure" illegal, State Attorney's Office requests rehearing

The State Attorney's Office filed an application for a rehearing in the case involving the "neighbor procedure." Minister of Defense Shaul Mofaz stated that he was interested in appearing before the court to explain the importance of the procedure.

The application was filed following the High Court's decision, given on 6 October 2005, that prohibits the use of Palestinian civilians in army operations.

IDF soldiers have used Palestinian civilians as human shields since the beginning of the current intifada. This practice is most common during IDF operations carried out in Palestinian population centers, as occurred in Operation Defensive Shield. Soldiers pick a civilian at random and force him to protect them by doing dangerous tasks.
